SeeHear End-User License Agreement ("Agreement")

Please read this End-User License Agreement ("Agreement") carefully before clicking the "I Agree" button, and using a product on SeeHear’s Platform ("Product"), such as a Demo, Perception Training or a Perception Test. By checking the "I Agree" box, or using the Product, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not check the "I Agree" box and do not use the Application. SeeHear LLC grants you a revocable, non-exclusive, non-transferable, limited license to use the Product solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Restrictions
You agree not to, and you will not permit others to license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Product or make the Product or any of its content or media available to any third party.

Modifications to Application
SeeHear LLC reserves the right to modify, suspend or discontinue, temporarily or permanently, the Product or any service to which it connects, with or without notice and without liability to you.

Use of Data
SeeHear LLC reserves the right to use data you generate by using the Application for the purposes of improving the Product. Your responses will be kept confidential to the extent allowed by the laws of the United States of America and the state of Virginia. Any use of your data in reports and nonscientific publications will be made anonymous so that it will not be possible to identify you.
Specific exceptions to the Use of Data terms may be made by way of a separate agreement, such as an Informed Consent agreement for allowing your anonymous data to be used in scientific publications, or an agreement allowing your data to be sent to your audiologist.

Limited Warranty
To the maximum extent permitted by applicable law, in no event will SeeHear be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or related to this agreement or use of the Product, including but not limited to lost profits, business interruption or loss of information or corruption of databases. Under no circumstances shall SeeHear’s total liability arising out of or related to this agreement exceed the total amount paid by licensee to SeeHear.

Term and Termination
This Agreement shall remain in effect until terminated by you or SeeHear LLC. SeeHear LLC may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from SeeHear LLC, in the event that you fail to comply with any provision of this Agreement. Upon termination of this Agreement, you shall cease all use of the Application.

Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Amendments to this Agreement
SeeHear LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
